Welcome to Passions 4 You. These Terms of Service (“Terms”) govern your access to and use of passions4you.com and any purchase you make through our online store. In these Terms, “Passions 4 You,” “we,” “us,” and “our” refer to Passions 4 You.

By visiting our website, creating an account, or placing an order, you agree to these Terms and to the policies referenced in them. If you do not agree, please do not use the website or place an order.

Our store is hosted by Shopify, which provides the ecommerce platform we use to offer our products and services.

1. Eligibility and acceptable use. You must be legally capable of entering into a binding agreement in your jurisdiction to place an order. If you allow a minor to use the website, you are responsible for that use to the extent permitted by law. You may not use our website or products for an unlawful or unauthorized purpose, interfere with the operation or security of the website, attempt to gain unauthorized access to systems or accounts, transmit malicious code, scrape or harvest information in an abusive manner, infringe intellectual property rights, or use the website in a way that violates applicable law or the rights of others.
2. Products and made-to-order production. Most Passions 4 You apparel is made to order after a customer places an order. Product availability, colours, sizes, materials, designs, and specifications may change from time to time. We make reasonable efforts to display product images and colours accurately, but screen settings, production methods, garment batches, and print placement can cause reasonable variations. Such normal variations do not necessarily indicate a defect. Please review product descriptions and sizing information carefully before purchasing.
3. Orders and order acceptance. Your submission of an order is an offer to purchase the selected products. We may accept, decline, limit, or cancel an order where reasonably necessary, including because of suspected fraud, payment problems, product or fulfillment unavailability, pricing or listing errors, shipping restrictions, or misuse of the website. If we cancel an order after payment has been collected and no valid charge remains due, we will refund the applicable amount to the original payment method where reasonably possible. Because production can begin shortly after an order is submitted, requests to change or cancel an order are not guaranteed once production has started. Please contact us as soon as possible if you notice an error.
4. Prices, payment, taxes, and duties. Prices are shown in the currency presented by the store and may change without notice before an order is placed. The price applicable to an order is the price displayed at checkout, subject to correction of obvious errors as permitted by law. Payment is processed through Shopify and its supported payment providers. You agree to provide accurate billing and payment information and confirm that you are authorized to use the payment method submitted. Applicable taxes, shipping charges, duties, customs charges, or other fees may be added as shown at checkout or assessed by authorities or carriers, depending on destination and applicable law.
5. Shipping and delivery. Made-to-order products require production time before shipment. During normal periods, most apparel orders are produced and ready to ship in approximately 4–7 business days. During busy seasonal periods, production may take approximately 9–12 business days. These are estimates, not guaranteed delivery dates. Shipping transit time begins after production and varies by destination, carrier, and service level. Customs, carrier disruptions, weather, peak periods, and other events outside our reasonable control may affect delivery. You are responsible for providing a complete and accurate shipping address. If an order is returned because an address is incorrect or incomplete, delivery is refused, or a package is left unclaimed, additional shipping charges may apply before reshipment. 6. Returns, refunds, and order issues. Because most apparel is made specifically after an order is placed, we generally do not accept returns or exchanges for buyer’s remorse, including ordering the wrong size or colour or changing your mind, except where applicable law requires otherwise. If an item arrives damaged, defective, misprinted, or incorrect, contact us within 30 days of delivery with your order number and clear photos showing the issue. Once reviewed and approved, we will work with you on an appropriate replacement or refund. Nothing in these Terms limits rights or remedies that cannot legally be excluded under applicable consumer protection law. Please review our Refund Policy for complete details.
7. Accounts and customer information. If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for activity conducted through your account. Please provide current, complete, and accurate order and account information and update it when necessary. Notify us promptly if you believe your account has been accessed without authorization.
8. Intellectual property. The website and its content, including Passions 4 You branding, artwork, graphics, photographs, copy, product designs, logos, and other materials, are owned by or licensed to Passions 4 You and are protected by applicable intellectual property laws. You may access the website for personal, non-commercial shopping and informational use. Unless we give written permission, you may not reproduce, distribute, modify, sell, commercially exploit, or create derivative works from our protected content.
9. Feedback and submissions. If you voluntarily send us feedback, ideas, reviews, photographs, or other content, you confirm that you have the right to provide it and that it does not violate the rights of another person or applicable law. Where you intentionally submit content for publication or promotional use, you grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce, display, adapt, and share that submitted content for the purpose for which it was provided, subject to applicable law and our Privacy Policy.
10. Third-party services and links. Our store may use or link to third-party services, including Shopify, payment providers, fulfillment partners, shipping carriers, analytics providers, social platforms, or other websites. Third parties operate under their own terms and policies. We are not responsible for third-party websites or services that we do not control. Your use of them is subject to their applicable terms.
11. Privacy. Our collection, use, and disclosure of personal information is described in our Privacy Policy. By using the store, you acknowledge that personal information may be processed as described there and as necessary to process and fulfill your order.
12. Errors and changes to the website. We may correct typographical errors, inaccurate descriptions, pricing errors, availability information, or other mistakes and may update website content when reasonably necessary. Where an error affects an order already submitted, we will handle the situation in accordance with applicable law. We may modify, suspend, or discontinue website features, products, or services from time to time.
13. Disclaimer and limitation of liability. To the maximum extent permitted by applicable law, the website and its general informational content are provided on an “as available” basis. We do not guarantee that the website will always be uninterrupted, error-free, or free from every security risk. To the maximum extent permitted by law, Passions 4 You will not be liable for indirect, incidental, special, punitive, or consequential losses arising solely from use of the website where such liability may legally be excluded. These Terms do not exclude or limit liability, warranties, conditions, guarantees, consumer rights, or remedies that cannot legally be excluded or limited.
14. Indemnity. To the extent permitted by law, you agree to be responsible for losses, claims, or reasonable costs arising from your unlawful misuse of the website, your infringement of another person’s rights, or your material breach of these Terms. This section does not apply where prohibited by applicable consumer law.
15. Suspension and termination. We may restrict or terminate access to the website where reasonably necessary to address fraud, unlawful activity, security threats, abuse, or a material breach of these Terms. Provisions that by their nature should survive termination, including intellectual property, payment obligations, and limitations permitted by law, will continue to apply.
16. Severability and entire agreement. If a provision of these Terms is found unenforceable, it will be limited or severed to the minimum extent necessary, and the remaining provisions will continue in effect. These Terms, together with the policies referenced on our store and any terms shown to you at checkout, form the agreement governing your use of the store and purchases from us, subject to applicable law.
17. Governing law. These Terms are governed by the laws of Canada, without limiting any mandatory consumer protections or rights that apply to you based on your place of residence or purchase.
18. Changes to these Terms. We may update these Terms from time to time to reflect changes to our store, products, services, practices, or legal requirements. The “Last updated” date above indicates when these Terms were most recently revised. Changes apply prospectively from the time they are posted, except where applicable law requires otherwise.
